I've just been told today by Ebay that I will not get a refund for a pin I returned to the seller, which was not as described, because she says she hasn't received it back, even though 27 days have elapsed. Ebay have closed the case, and I have been told that I can appeal the case if I have new evidence, however, my Ebay page has no options for me to do this.
Background: I purchased a pin from an Ebay seller in the USA, it cost me $35 plus $12 postage, I confirmed with the seller that I would be getting the pin in the auction picture, but on arrival the pin had missing enamel in two places, and was clearly not the pin listed for sale. I requested a return, the seller was not happy, insinuated some things but eventually agreed to accept the pin back. Ebay now states that sellers have to pay the return postage if an item is not as stated, however she did not want to pay for a signed service and only agreed to pay for standard air mail. In good faith, I mailed the pin back to her and got proof of postage, however 27 days on, she says she hasn't got the pin back. My view is that I have fulfilled my obligations in this matter, and as she wouldn't pay for a signed for service, why should I be held responsible? However, she got Ebay involved and they say she doesnt have to refund me, because she says she hasn't received it back. So now I'm out of pocket by a lot of money, and just feel that the seller knew what she was doing all along. This seller is a Pinpics member too, and I feel very sad that people in the hobby can use the system like this.
So please please be careful when returning items, and make sure you get a tracked signed for service.

UPDATE: After three days of ringing Ebay and being left on hold, I finally got through today. They were very close lipped and no-one wanted to comment, I was passed around a bit, before being told, the only way I'm getting a refund, is if the seller confirms receipt of the pin. I have thirty days for this to happen, after which time, the case cannot be re-opened. I now know that, If your seller refuses to send you a prepaid returns label, contact Ebay and they will issue you with one at the sellers expense. This information is too late for me but I hope it helps someone else.
Hi docfish2u .... thanks for your concern ..... it was returned by standard air mail because that's all she agreed to refund, £3.15, she wouldn't agree to pay for a signed service. So of course, I'm out of pocket by that as well, which totals around $50, so no pin and no money. The receipt I have, just shows the date I sent the package, the weight of the envelope and her address. So there is no way to track it, unfortunately. I supplied Ebay with photos of the pin and the return postal receipts, I'm just feeling the injustice of the situation!
By the way, perhaps I should point out, the seller sent me a message saying she could not send me a prepaid return label, and I was asked to take the parcel to the post office and pay over the counter for the return postage, which I would later be reimbursed for. As I say it, I just feel really stupid that I agreed to this .....
The whole situation just sucks. And I wouldnt feel stupid over this. Most people are "nice and good folks". I'd rather keep that outlook than be suspicious of everyone. Unfortunately there are "those" people out there who are just a PIA... So sorry this happened to you.

27 days does sound like a long time for it to be on the way still, and even more days have passed now. So sorry this happened to you!
I'd keep a close watch on the seller's profile though, just in case the pin resurfaces.

Horton Who, I realise that some people may be concerned and want to know who this seller is, for me, everything about this transaction screams that the seller knew what she was doing every step of the way, however I am a reasonable person and appreciate that there is a slim chance that this was all an honest mistake. So with this in mind, I could not in all conscience release her name to all and sundry, but in good faith have given her name to senior members within the pin community who I hope will be discreet with the information.
This particular seller only has around ten pins listed for sale, so is not likely to affect a large number of people, my sincere hope of course, is that this was an isolated case. The main point of my post was to inform people of the situation in general, so other community members can avoid falling prey to something that can quite innocently transpire.
I am not sure how eBay could send a prepaid label when it is international (can international members use PayPal to print up shipping labels?) Maybe they would have had you send it to their UK Global Shipping Centre address?
Maybe the seller actually hasn't received the item yet. I know I've had some international packages sent to me that I don't get for more than a month
its quite possible with the Global Shipping Centre .... You're actually in the same State as the seller, starry_solo, being on the furthest part of the US, I have continued to hold that hope, that the package just hasn't arrived yet. However what has been frustrating, is that the seller contacted Ebay and got the case closed. I pleaded the case for flooding and tornado conditions affecting postal services, being a strong reason for leaving the case open longer, but Ebay wont re-open the case unless the seller confirms receipt, and there is a limited time frame for this to happen. :crazy:
