OKAY so here is what i was asking in a more detailed thought and clarification....

When you pin trade you are making a verbal contract. Minors cannot legally enter into verbal contracts. So there is a liability there. There is no recourse you can take with a minor on this. With people of legal age there are numerous avenues to take. Mail Fraud etc. Most of us would never enter into a legal contract with a minor due to this. My thread was only meant to make people think of the legal repercussions. As in DPF has a chat room. How do you know you are not chatting with a 13 year old girl. Now imagine you are and her parents see this chat and some things said are not appropriate for a 13 year old girl. So now the parents are reporting this to law enforcement. Your butt is in a legal bind now. If DPF has no disclaimer saying you must be 18 then its wide open to this kind of behavior and yes lawsuits and criminal charges. YES people can lie about their age. But when they do and something like this happens then DPF is not liable. I am merely wanting people to think about this. Would you enter into a chat room with minors? I absolutely would not. Not to mention the private messaging going on. If DPF had an age requirement stated then legally it would not be responsible. I dont think banning underage traders and members is the answer. But requiring anyone under 18 to make their age known would be a good idea. Wouldn't you want to know to cover your own butt? Let them be members but have them post their age on their profile. I wouldnt allow minors in chat its too much of a disaster waiting to happen. These were my concerns when I posted the original question. I am in NO WAY saying underage traders are not trustworthy. Many are just as trustworthy as someone 90 years old. But recently I went into chat and someone I KNOW that is not 18 was attacking others. People defended themselves as I would expect. But how many would be hesitant knowing this person is a minor? We have all seen dateline so now your in chat the person is underage you say hey we should meet up the next time at the park ( Yes we know you mean to trade pins) however his or her parents DONT know this. They see it and report it next thing you know your at the park face down in handcuffs. Just something for DPF and everyone to think about. I have said my peace. Happy Pin Trading everyone.

People are crazy, at any age!

When there are young ones involved though, there needs to be some precautions, not only for adults but for the minor as well.

I do not think it is such a bad idea to have a disclaimer about age.

TabbiKat being in the profession she is in seems to have some insightful information.

Remember, we live in a country where people sue Mc Donald’s for making them fat!

I know on certain other sites, you must be 18+ to engage in any form of E-Commerce, such as buying or selling. Take E-Bay as an example

When eBay members agree to buy or sell items, they are entering into contracts with each other. Throughout most of the world, individuals under the age of 18 are not allowed to enter such contracts. For that reason, we can't let members register until they are 18 years old.
 
I am not AFTER anyone but hey if you want to take the risk go ahead And it wont matter if your bag is full of pins or not meeting with a minor without the parents consent will get you arrested. And that you can take to your attorney.
 
Playing devil's advocate here:

While a pin trade here, on PinPics, etc, might be considered a binding agreement, especially if one party sends theirs and the other party does not, this is a unique hobby we all are part of. Pin Trading as a whole spans the age spectrum, kind of like LEGO, you know, ages 9-99. Not taking into account the "sharks" at EPCOT who freak if a little one breathes on their pins wrong, there were times that kids who could not be older than 10 came up and wanted to look in my pin bag and I had no problem showing them and even trading a couple with them, and I am in my mid thirties. It was said elsewhere that someone who is 15 could be a better person than someone who is 40, and that every person should be judged by their actions, and not their age, and I agree with that wholeheartedly. However, I do think that DPF should have some form of protection since there is a mixture of minors and adults interacting in chats, discussion, trades, and Buys/Sells; that is if there is not already something in place.

Yep I agree however would you approach a 10 year old without his parents there? Or have discussions with them and trade emails without parental approval? I agree they shouldnt be banned as I love having young people involved in trading. I love to give them pins at parks but I would not do so without asking parental approval. And if someone on here is under 18 I want to know for my own sake. Not to not trade with them but to make sure everything is parent approved. Personally I will not knowingly trade with a minor online or enter into chat with them there. Too many legal complications.
 
Another thing to consider many people sell pins on here. Lets say a 15 year old is on here decides to purchase your pin uses "moms" paypal account you send the pin. The mom finds out and reports it as fraud. They didnt authorize the payment. Now your acct has the money taken back or and investigation. Now you have to fight to get your money or your pin. Because as I have stated before minors cant be in legal contracts. You may get your money or your pin you may not. But now its on you to fight to get it. What will happen to the minor? Nothing. My point here is not to attack anyone but to have everyone think about this and realize this may be a problem that can be avoided.
 
I agree with you Tammy. It is best to be proactive about these kinda things instead of having to worry about it later. In no way am I saying that people under 18 should be excluded, but considering these kinda things is always a positive. Even a disclaimer would at least acknowledge the issue.

As usual you have no idea the legal implications but I can give your the number to your local FBI office if you wish and they can most certainly clarify the issue for you. Or you can call my office directly. It will in no way guarantee a trade but it will protect your butt. And I would be first in line to arrest someone that was speaking improperly to a minor. THAT I WILL GUARANTEE. So the issue is should you know the age of any minor you are dealing with.
 
Oh and Grim yes you can protect yourself on the internet its called DUE KNOW WHO YOU ARE SPEAKING TO. If you have children would you approve of the chat room here? or even your own posts?

If you are too worried about certain legal ramifications, then I might suggest that the best thing for you would to stop trading on here. That's the only way you can guarantee you are not trading with any minors.

It seems to me that you just get frustrated when someone has an opposing viewpoint to you. That is key to a valid discussion. It kinda reminds me of Cartman when he doesn't get his way:
 
Just to point something out... I would say that most of the people on this site and on PinPics are 18 and up... so I'm not sure why there is a worry for trading with minors... I know of a lot of irresponsible adult pin traders *hintity hint hint* so minors may be more responsible than those irresponsible adults. It doesn't really matter what age someone is... just be careful when trading. Thats all you can do.

That is exactly my problem. From reading all these pointless threads, the one thing I noticed was that anytime someone didn't go with the flow some rude comment was made towards that person. Makes me happy to see people not just go with the flow, and I wont even go into mentioning the involvement of the FBI. I literally laughed out loud. It's one thing to be upset, but when you beat a dead horse (as amazingly pointed out by Grim) it gets really annoying. I really don't see the point in this, whatsover. Maybe I would have if I wasn't so turned off by someones attitude at everything said.

Should we post all those warning signs all over it "18+ ONLY ADULT CONTENT INSIDE. YOU MUST BE 18+ OLD TO CONTINUE AS IT'S ILLEGAL FOR MINORS TO PIN TRADE OR TO TALK IN A CHAT ROOM."

If you don't like the person/dont want to ever talk to the person/trade with them/see them ect, be a grown up for crying out loud, and IGNORE THEM. BLOCK THEM! This isn't high school where your goal is to turn everyone you know against one person because YOU HAD A PERSONAL ISSUE WITH THEM THAT DIDN'T INVOLVE THE REST OF THE WORLD. You don't want minors on the site or pin trading, yet I know several minors that act more mature then what I've seen in these threads.

For the record, I'm on no ones side. But I find it a bit immature that you have to post THREE, not ONE, OR TWO! but THREE THREADS (TWO which were closed, I guess that wasn't enough of a "drop the subject" hint) about the ordeal. THIS IS PIN TRADING! IT'S SUPPOSED TO BE A FUN HOBBY! But reading all this BS about NOTHING makes it just the opposite.

As said before, leave the dead horse alone. ITS DEAD. END OF STORY. HAVE A MAGICAL DAY.
