Just because Pin Pics imported a Disney pic and watermarked it does not grant them ownership rights. A great deal of those pictures are available without their watermark on them and anyone is free to use them without Pin Pics blessing. Disney would be the only entity that would have a say in whether there was an issue with other sites using them. If I'm misinterpreting your statement, then please clarify.

Yes, Disney SHOULD be the only one to have an issue with watermarking their pics but, PinPics has claimed those are "part of their database" since members submitted them.

Lawyers can claim anything in court and then you have to pay a lawyer to dispute. Just be careful.......

I have no issue with Pin Pics putting a watermark on an image if that is what they choose to do, but if PTDB or any other database uploads the same Disney pic without the watermark, Pin Pics has no claim to copyright and would be wasting their own money going to court over it. Also, even if a user uploads their own pic to PP and then also shares that image to another database(s), they have no claim. No one should be bullied with scare tactics, everyone just wants to have fun with their hobby.

They have far less community goodwill to get away with knowingly submitting nuisance suits. It would be much more expensive for them than for anyone they went after.
 
If I submit a picture to PTDB first and then Pinpics after, wouldn't they have no grounds to claim that they own the image. Or if I put it on a website that hosts creative commons images. If I as the original owner of the image decide to make it freely available before putting it on Pinpics, they should have no claim to the image. Also, Facebook didn't get away with claiming that uploads belonged to them so how would Pinpics do it?

Also, couldn't people who upload the pictures sue Pinpics for lack of fair compensation for their work? You are providing a service, therefore you would be owed fair compensation for Pinpics to take over ownership of your work.

Like when I added stuff in, I would edit it for a max of ten minutes per pic and then add descriptions for an additional 5 minutes per pin. Wouldn't I be owed compensation for my time if they want to claim it's their's?
 
There terms and conditions for use of the site are interesting. If I read correctly. Anything you upload as pictures they claim as intellectual property. Any artwork is Disney’s. Plus if you want to use their content you can as long as you given them the resulting product. Non lawyer interpretation.

I'm actually wondering are their terms of service legal under the current copyright law? From what I can gather (an hour of research), they could co-own the copyright, but they could not make you relinquish your copyright completely with the terms of service. Social media doesn't even touch on this, because it's a legal battle just waiting to be fought; they license your image or words for free. If what I'm researching is correct, if you're the original uploader of the image, you should still retain your copyright to both the image and the words regardless of the terms of service.

Here's the old ToS and the new one. I find it interesting that they add the copyright and trademarks AND/OR licensing the images and content.

Interestingly enough, it has Disney Interactive as a arbitration party? So, I went on the Disney Interactive's (now just The Walt Disney Company) ToS and it was pretty much just copied and pasted using the word Pinpics instead of Disney for most of the legal jargon.

How many pictures from their database ended up on your site and how were those pics downloaded from PinPics? Much of their early listings would be next to impossible to duplicate.
 
The way that site worked was you would tell it your pinpics info and it would go get all your stuff and copy it to the new site. So it had a lot if pics in a very short time. The beef or rub is that everyone gave the pics to pp and did so with the thought the site would be free forever and never be restricted in any way. It was built by and for the pin community.

I still think that a few pin meet ups all around the place could get thousands of pics of everyone's pins in one big swoop. The only thing after would be uploaded all the pics. But either way. If we all did it before, no reason it can't be done again.
 
it is over and done with but I want to say that while PinPics was down/not operating properly for 12 days;
that our Owner had 3 Programmers (if you have any clue as to what they charge per hour then you know
that this was not a $ issue) searching for any problems on our end as Servient continued to say the problem
was on our side. They went through every line of code to determine without a doubt even though we knew this
to be a fact that it was due to their security update, a heated phone call was made and within 15 minutes they
had us back up and operating. At that time we contracted a new server company and we switched over. The
only hiccup that we have had since was when the new company were upgrading our hard drives. I was in touch
with one Programmer who was on this immediately and we are smooth sailing.
It has taken several years to get our new database built and the projection will be to have that launched within
60 days. (Programmers/ Web Developers are human so this is a projection - who knows what may come up)
It will have some awesome new features to help all traders. I have been a loyal supporter of PinPics since 2002,
and will continue to do so. Change is not always easy, yes, we miss some old features but newer ones are appreciated
as well. I am looking forward to seeing what PinPics has to offer.
 
Yeah, I can’t get into the forum either. So will ask my question here to @PinPics_Ambassador - Any word on when the trade assistant will be fixed? Right now it sends out a request to only one person regardless of how many you clicked on.

FYI, I hate having TapATalk and I have never signed up to it but I am able to post there.
It is just wrong to me that someone says You HAVE to do this .. and I am stubborn, it's
a family trait lol

We have a GREAT Programmer, who although not being a Pin Person, is in tune to what we want/need.
PinPics is going on 19 years old and it can not keep up with everything new in the Technology World. We
have to have a NEW Database. What we have with the old one is what we have until the new one is up
and running.
Trade Requests have started coming through to my Yahoo mail again, I do not know what changed.
(they were not coming through at all and we had to login to PinPics to see them)
You will have to continue to Send 1 Request to 1 Trade Partner at a time until we have the new system up.

There are wonderful new features in the New PinPics. Members who do not log in in 30 days
will automatically be set to inactive so no Trade Requests will go to them. This should help cut
back on the discouraging 'no reply' to TAs. We may even have some sort of system that will
Grade us as Traders and we will be demoted, for lack of a better word, if we don't reply. I am
hoping for a Drop Down box with Checks for Reasons to decline a Trade to make it easier on
everyone.
Example;
This is not a fair trade and I can not make it.
I am holding this pin for a specific Trade, Thank You.
This trade is not high on my Wants List so I will pass.
It may even block traders who daily send you the same Trade Offer even though you have politely declined.


We have an ongoing discussion concerning what we as Traders NEED in PinPics, if you'd like
to join us.
Our New Database is a Couple of Months Out .. what do you think ... ???
