Give it another couple of days. If you don't hear back call your credit card and go from there. And make sure to return the item when your credit card refunds your money. Not fair to keep the money and the pin.

Let me also add in my experiences purchasing the PODM pins every month I can say that I have never seen this kind of scratch pattern. It looks like someone tried to clean it in a circular motion.
 
I believe from looking at those pictures it is the same pin, it's just in different lights the scratches look worse. I know how frustrating it can be trying to get your point across as something similar happened to me recently (not with a pin though).

Unfortunately it will always be your word against theres and vice versa.
 
What a terrible seller.

The scratches DO NOT look like they were made by being cleaned in a circular motion. We've seen pins with these types of scratches (though not as many) when we have been purchasing the PoDMs at the park. They're made by the manufacturer. Clearly the seller had an ulterior motive and tried to sell off an inferior product. As for if they're the same pin - the image is exactly the same - (count the specks of light coming from the rose). It is absurd that you even have to go through this. We hope everything gets fixed.
 
The one thing I really don't get is I'm sure the seller could receive a refund by taking the PODM back to Disney with the receipt. And this is someone who I know is at Disneyland all the time. It's not even like the seller would be taking a loss here except the shipping. But it's almost not even the money anymore.

The seller emailed me back admitting that she has blocked me on DPF, completely ignored my questions regarding giving me her address so I can send the pin back and get a refund, and then proceeded to go into a long tirade filled with profanity, name-calling, and accusations. She also said she had more important things than to deal with me. I'm not sure I'm expecting another email back from her, but I tried to send a civil response.

Waiting to her back from the mods and Cicada (full PM box). So at this point, my only recourse seems to be this thread, negative feedback, and PayPal/my credit card company. But I'd at least like to return the pin before I go through all that trouble, but the SELLER REFUSES TO GIVE ME HER ADDRESS! Oh, and at the same time she is accusing me of stealing the pin by not returning it.

I've just never been so frustrated in all my life about something so seemingly simple. How can someone who seemingly is constantly buying/selling pins be acting like this? Grrr. :cry:

You have 45 days from the date of payment to file a claim with PayPal, which probably won't side with you because you sent as a gift. I'm not sure how long you have with your credit card company to dispute an item, probably a little longer (I know I disputed an item I had purchased 3-4 months prior because it broke down then and when I contacted the manufacturer, I found out it was counterfeit).

So, at this point, since you're not going to get any further communications from the seller, I would:
1. Dispute the issue with PayPal;
2. Wait the requisite amount of time for PayPal;
3. Dispute the issue with your credit card company, who will then contact PayPal, who will then contact the seller (this drags it out a bit). When you dispute the issue with your credit card company, advise them that the seller didn't provide you a return mailing address (but go and check your PayPal receipt because it should have a return address on there and what happened to the envelope?)
4. Where's the original envelope? If the package was insured with the post office and the claim is the post office damaged it, someone's going to have to bring all the packing materials to the post office.

The buyer mentioned they paid fees so I think they didn't send payment as a gift. That gives them a shot at getting their money back through PayPal. If they go the credit card company route I think PayPal ends up banning them for life.
 
Sorry, for clarification.

I did send it as a gift, but I used my credit card to fund the gift as I didn't have a PayPal balance at the time and the seller wanted the money immediately (they'd have to wait for an eCheck to clear). I paid fees for this and in retrospect, at this point I should have just sent it as goods, but I wasn't trying to cause any trouble and just did what the seller asked.

There's no address as far as I can tell given to me when I sent them the gift via PayPal. I've looked all over but maybe I'm missing something.

I tossed the original envelope immediately before I noticed a problem as the packaging seemed good. It didn't even occur to me that I'd have trouble getting the address in the future, so I made no attempt to get it out of the trash once I realized we had a problem. This just isn't something you think of at the time if you aren't anticipating trouble.

The package wasn't insured, so nothing to file with USPS. Not sure that's the culprit anyway and I've given up on trying to figure out how the PODM got damaged, because it doesn't really matter in the end to me.

I'm sorry you are having to deal with this, and I'm sorry that once again the moderators/admins are absent.

However, my first reaction when seeing the scratches was that I wondered if it was from a pin without a pin back rolling around and the exposed post scratching the cel. Something like that could happen from being shoved around the tubs Disney uses to hold the pins (at least at Pin Traders in FL) as they grab pins to show and throw back the rejects. But it could also happen from carrying a bag around all day, riding rides or whatever. I can't even count the times I've gotten home and found a pin back that has worked its way off a pin. I always worry it has scratched something important, and these cels are more fragile than regular pins.
 
Oh wow! those scratches look deep, I don't see how rubbing of a pin book page or another pin contacting/ rubbing it did that, im so sorry this has happened, I think you have received many great advice, I would get a hold of a Mod as third party help. Good luck and hope all turns out well in the end.
 
Paypal won't help you since you sent the moneys as a gift and it was not an ebay purchase. Don't waste your time with them. Go straight to your credit card.
 
paypal will not be able to do anything, neither will you credit card you sent it as a gift you can not ask to have a gift returned, if you had checked "purchase, and then goods" you would be able to try a chargeback, but there is no way the credit card co. or paypal will refund on a gift.
It is sad though that you are having a problem with the seller though, I hope you can work out something.
 

I'm pretty sure the credit card company will still help you out; they have no way of knowing that you clicked "gift" when you sent it via PayPal. Just go to them, but I still recommend the steps above.

BTW, never throw away an envelope. It can always be reused
 
Well, I finally got the address! It was accompanied by a short note to "Send the exact pin I sent you;" and nothing else, but at least I have something I can do to move this forward. Still concerned I'm not getting a refund after I return the pin, but at least once I no longer have the pin, I can move forward to other ways of getting retribution if I'm not refunded by the seller.

I'm a little confused. You said that you paid as a gift, but then you said you paid fees. Ive paid by gift and have never had to pay fees, so I'm scratching my head here a bit.
 
I think it's a matter of whether you have a bank account or a credit card attached to your Paypal. If you use a CC, there are fees. If you use a bank account or balance, no fees.

+1. I never have to pay fees when sending as a gift using a balance. I don't have my PP linked with my bank account though (it scares me!)
 
I have to pay fees when I use a bank account too, although the percentage charged is much lower. It might be different if you actually have a balance on Paypal? (I've never been a seller so I've never had a balance to use.)
 
To clarify:

I don't get charged fees if I have a PayPal balance OR use my bank account to fund the gift payment. The problem is using my bank account to fund the payment takes approximately 3 days before the funds clear and the person I'm paying can use the funds.

Sally didn't want to wait for that, so I said I'd pay the fees and used my credit card to fund the gift payment.

Just FYI: when you hit a certain dollar amount paid by Paypal (lifetime, not monthly), they require you to link a bank account before you can pay for anything else. What's worse is that there's no good reason for it in terms of guaranteeing payment - they just want to encourage you to use a bank account rather than a credit card so that they'll pay lower fees. I ran into this recently, and there was no way around it, even when I called their customer service.
 

I think when you hit $250-500 is when you have to link a bank account.
